Omar Abdullah demands SIT probe into Shopian killings

Urging the government to constitute a Special Investigation Team (SIT) to probe the Shopian civilian killings, former chief minister of Jammu and Kashmir Omar Abdullah on Friday said his government had sought permission from Centre in 50 cases to prosecute security forces involved in human rights violations, but 47 cases were rejected and three received no reply.

'' It means no permission was granted in all 50 cases,'' Omar said in the Assembly on Friday.

He said the Centre, since 2000, has not given permission to prosecute security forces personnel involved in human rights violations.

''If this is the track record, please tell us from where you (Mehbooba Mufti) have got this confidence to take the investigation into the killings to the logical conclusion,'' he said.

Omar said the police have filed an FIR against the Army and the Army has filed a counter FIR.

''When there are two FIRs in the same police station what will the SHO do?'' he asked. ''I request you (Mehbooba) to set up a high-level SIT, besides the magisterial probe into the killings.''

He said it is not an ordinary investigation as there are two FIRs about the same case.

''You (Mehbooba) should order the constitution of a high-level SIT that will investigate the two FIRs,”  he said.

Omar said during his tenure as the chief minister, Army jawans involved in Machil fake encounter were court-martialed, but the decision was being reversed.

He said a BSF officer, who fired indiscriminately at Brain in Srinagar, was also arrested.

The Army has objected to police registering a case of murder (section 302), attempt to murder (section 307 ) and endangering life (section 336) of Ranbir Penal Code (RPC) against the troops of 10 Garhwal unit led by Major Aditya.

The move has irked the BJP, which has demanded the withdrawal of FIR against the Army.

The police have clarified that it has not entertained a separate FIR by Army but incorporated the Army's version into the FIR lodged against the Army.

Mehbooba, however, dismissed reports that two FIRs were filed in the case. ''On January 27, an FIR was lodged and on January 28, the Army  gave its version of the incident which is part of the original FIR,'' said the chief minister.

She said they have to listen to both sides and it can’t be one-sided.

On January 27, three youth of  Shopian—ayees  Ahmad, Javaid Ahmad Bhat and Suhail Javaid Lone— were killed when troops of 10 Garhwal unit fired at stone-pelting mob at Ganawpora.

Seven Army men including Junior Commissioned Officer (JCO) were injured in the stone pelting on their convoy.

The incident created a tense situation across Kashmir and put the government in a state of bother. Fearing protest, the government asked the police to lodge an FIR against the Army and also ordered a magisterial probe into the incident to calm the tempers.

Mehbooba rejected demands by the BJP to withdraw the FIR against the Army and said there are black sheep within the Army who needed to be weeded out to enhance Army's grace.
