Kalyan Bainsla, the main accused in the Gurugram hit-and-run case, was detained in Rajasthan hours after police added an attempt to murder charge following widespread outrage over the incident.
Gurugram Police registered an FIR on Monday under Sections 281 (rash driving) and 125 (causing injury) of the Bharatiya Nyaya Sanhita. They later added Section 109 (attempt to murder) to the FIR.
The incident took place on Sunday when Bainsla’s car allegedly rammed into a two-wheeler from the side on Golf Course Road, knocking the woman biker off her vehicle and causing her to skid several times along the road.
The biker, Shivani Chauhan, who identifies herself as Sia on social media, escaped with minor injuries. She later shared footage of the incident recorded by a camera mounted on her Aprilia RS 457 sports bike.
The case took a contentious turn on Monday after Bainsla, a gym owner who describes himself as an international kabaddi player, claimed that the collision was an accident and that he did not deliberately hit Sia.
“I was travelling with my family. I didn’t make any gestures at the young woman; I simply asked her to ride her bike slowly. I admit that a collision occurred. Had I stopped right then, those people would have beaten us up,” he said.
Bainsla also claimed that the woman biker and other motorcyclists were riding at high speed and allegedly trying to provoke him.
His remarks drew a sharp response from Sia, who posted an Instagram video saying the footage clearly showed what had happened.
“He is saying that we were riding the bike very fast on purpose and that we were trying to provoke him. But the footage clearly shows who was actually provoking whom,” Sia said.
Sia also alleged that she was targeted because she is a woman biker and there was a deliberate attempt to stop her. She claimed that her life could have been lost and the accused did not even attempt to check if she was safe following the accident.
"I feel ashamed of such people. Women feel unsafe on the roads of Delhi and Gurugram," she added.
At least two videos of the alleged collision have surfaced on social media. One of the videos captured by Instagram user 'youknowabhishek_' shows the car driver first signalling Sia to stop. When she did not stop, the accused steered the car toward her Aprilia RS 457 bike and hit her from the side.
Sia, a resident of Delhi, has completed a course in fashion designing and also contested the 2022 municipal elections from Kalkaji. Her father Roshan Chauhan is a member of the Aam Aadmi Party.
