Writ petition in UP HC against CM Adityanath for model code violation

He has been accused of continuous violations of model code of conduct

A writ petition has been filed by a former cop against Uttar Pradesh Chief Minister Yogi Adityanath for "continuous violations of the model code of conduct."

Amitabh Thakur, an IPS officer who was forced into taking voluntary retirement in 2021, moved the High Court to complain that the CM has been constantly giving speeches that were aimed at brewing tension between different communities.

Thakur alleged that in Badaun, Meerut, Mathura, Bareilly, and Pilibhit, besides other constituencies, Adityanath has given speeches that can stoke communal passions.

He had approached the Election Commission of India on two occasions earlier but received no response.

One of the examples given by the petitioner is a public meeting in Mathura on March 27, where Yogi had said Lord Ram had enjoyed Holi from his new abode in Ayodhya and it is natural that there would be a similar wait in Mathura and Vrindavan.

The compliant reads that Adityanath is clearly indulging in an activity that is going to “aggravate existing differences between the two communities...and is going to aggravate mutual hatred between them.”

The petitioner describes Adityanath as a “highly experienced politician” who “fully knows and understands what he was doing and what feelings he was stroking, merely for gaining votes and for polarising of votes on religious basis.”

Thakur, who has pleaded that the court issue an order of mandamus (we command), said, "I have pleaded with the court to give directions to the Election Commission".

The writ has been filed in the Lucknow bench of the Allahabad High Court.
