Nirbhaya case: CJI Bobde recuses, new bench to hear convict's review plea

Bobde said he would constitute a new bench to hear the plea at 10.30am on Wednesday

Chief Justice of India S.A. Bobde on Tuesday announced he was recusing from the bench hearing the review plea of one of the four men sentenced to death for the gang-rape and murder of a physiotherapy student in Delhi in December 2012.

Chief Justice Bobde was heading the bench consisting of Justices R. Banumati and Ashok Bhushan, which was hearing the plea filed by Akshay Kumar Singh against the Supreme Court order of 2017 that confirmed his death sentence.

CJI Bobde announced he was recusing from the case as his nephew, Arjun Bobde, had appeared for the victim's family in earlier proceedings.

According to Live Law, CJI Bobde mentioned whether he should hear the case after seeing the name of an advocate on record on the case file, apparently referring to Arjun Bobde.

Chief Justice Bobde said he would constitute a new bench to hear the plea at 10.30am on Wednesday.

Akshay Kumar Singh's lawyer, A.P. Singh, had argued on Wednesday in the Supreme Court against the way investigation in the case was conducted.
