The Delhi High Court will hear Jammu and Kashmir MP Rashid Khan alias Engineer Rashid’s bail plea on February 24. The development as the Court granted two-day custody parole for the MP to attend the Parliament budget session.

Hearing the matter, Delhi High Court Judge Vikas Mahajan deferred the hearing on the plea after the counsel for High Court administration informed the bench that the Supreme Court has clarified the jurisdictional issue regarding hearing Rashid’s bail plea.

The High Court had sought a clarification from the apex court regarding hearing the bail plea after the NIA Court refused to hear his bail plea in terror funding case owing to his election as an MP. As per the Supreme Court’s earlier judgment, the MP/MLA court should be hearing pleas related to public representatives.

Rashid moved the High Court after he did not get a remedy from the NIA Court. The High Court bench also orally directed Rashid's counsel to approach the NIA court for bail as the apex court has clarified the issue.

The Baramulla MP is facing trial in a terror funding case with the allegations that he funded separatists and terror groups in Jammu and Kashmir. Rashid has been lodged in Tihar prison since 2019 after the NIA arrested him under the UAPA Act for allegedly funding terror activities.
