The Lok Sabha Secretariat on Friday issued the notification disqualifying Lakshadweep MP Mohammed Faizal, who recently got convicted in an attempt to murder case by the sessions court in Kavaratti.
As per the notification issued on Friday, Faizal stands disqualified from the membership of Lok Sabha from January 11. The step was taken under the provisions of Article 102 (l) (e), Section 8 of the Representation of the People Act, 1951 of the Constitution.
"Consequent upon his conviction by the Court of Sessions, Kavaratti, Lakshadweep in Sessions case no. 01/2017, Shri Mohammed Faizal P.P., Member of Lok Sabha representing the Lakshadweep Parliamentary Constituency of the Union Territory of Lakshadweep stands disqualified from the membership of Lok Sabha from the date of his conviction i.e. 11 January, 2023 in terms of the provisions of Article 102(l)(e) of the Constitution of India read with Section 8 of the Representation of the People Act, 1951," read the notification.
Along with Faizal, four people accused were sentenced to 10 years after they were found guilty in the attempt to murder Mohammed Salih, son-in-law of late Congress and former Union Minister P. M. Sayeed. The incident happened during the 2009 Lok Sabha elections.
The court has also imposed a fine of Rs 1 lakh each, who are the relatives of late Union Minister Sayeed.
According to the prosecution, the Lakshadweep MP and 36 other accused along with other identifiable persons, armed with deadly weapons, committed offence of rioting and voluntarily caused hurt on Salih after wrongfully confining him and his friend Mohammed Kassim at a place at Androth island. According to reports, Salih was severely wounded in the attack and was airlifted to a hospital in Kochi.
