One of the four convicts in the Nirbhaya gang rape and murder case, Akshya Kumar Singh, who moved the Supreme Court Tuesday seeking review of its 2017 judgement handing down death penalty to all of them, requested the apex court to exempt him from death penalty saying he is anyway dying due to pollution in Delhi.

The SC, on July 9, 2018, had dismissed the review pleas by Mukesh (30), Pawan Gupta (23) and Vinay Sharma (24), saying no grounds have been made out by them for review of the verdict.

In his mercy petition, Akshya, 31, who had not filed the review plea earlier with other three convicts, argued that he was incorrectly convicted, say media reports.

Bringing up Delhi's air quality in his petition, he said the metro city is like a gas chamber. The water in Delhi and NCR is full of poison and everyone is aware what is happening with regard to water and air, said the petition. Further, he told the court that life is anyway short and asked why give him death penalty, according to media reports.

The apex court, in its 2017 verdict, had upheld the capital punishment awarded to them by the Delhi High Court and the trial court in the case of gang-rape and murder of the woman. One of the accused in the case, Ram Singh, had allegedly committed suicide in the Tihar Jail.

Meanwhile, Tihar jail officials announced that one of the four convicts in the case has been shifted to the prison from another institution.
