CJP’s Saurav Das and Ashutosh Ranka withdrew their plea before the Delhi High Court challenging the extension of their custody and seeking immediate release.
The development comes after the court questioned why they approached it when their Special Executive Magistrates' proceedings were due to take place later in the day.
The court advised them to wait for the outcome of the SEM proceedings and then consider legal remedies.
The Activists had challenged the SEM’s October 19 order to extend their custody until October 21. The SEM had cited concerns for public peace and said that the CJP leaders showed no respect for law by repeatedly calling for protests at the de-notified sites.
They argued their detention was illegal and violated their right to personal liberty.
The Delhi court observed that the two had furnished their bail bonds on October 11, the same day the Jantar Mantar was de-notified as a designated protest site before being arrested again.
The court questioned why the procedure prescribed under the BNSS for breach of bail bonds was not followed.
The court also observed that the two were not from Gen Z and asked what the term meant,
Advocate Abhik Chimni told the High Court that Saurav Das is 27 years old and Ashutosh is 32 years old. After being told that Gen Z refers to people born after 1997, the Court reiterated that the petitioners did not belong to that generation.
Advocate Abhik Chimni and CJP legal affairs head Ratna Singh arrived at the SEM court on Wednesday after the High Court's observations as the custody of the CJP leaders ends today.
Meanwhile, All India Students’ Association (AISA) president Neha Bora’s petition will be heard tomorrow at 10:30 am according to her lawyer Chimni.
The HC is scheduled to hear Bora’s petition challenging a Delhi police notice asking her to furnish a personal bond of ₹10,000 and one surety.
