Cockroach Janta Party founder Abhijeet Dipke was released after he was produced before the Special Executive Magistrate at Mandir Marg on Saturday.
The court ordered Dipke to be released from police custody after granting him conditional bail. He was also asked to sign a peace bond and furnish a surety worth ₹50,000.
Dipke was produced in court a day after he and All India Students’ Association (AISA) president Neha Bora were detained ahead of a planned 'Lehra Do Tiranga Yatra' rally in the national capital. He was detained under sections 126 and 170 of the Bharatiya Nagarik Suraksha Sanhita (BNSS).
Bora was released early on Saturday.
Police told the media that Dipke’s arrest was to prevent a breach of peace. Meanwhile, several lawyers were denied entry to court by security outside the magistrate as the hearing took place.
Ratna Singh, CJP's legal affairs head representing Dipke, had questioned the legality of his detention and urged the magistrate to order his release, alleging violations of due process and fundamental rights. In a post on X, Singh wrote, "The SEM Court should release Abhijeet Dipke, as his arrest is unlawful. He merely urged people to unfurl the Tiranga - how can that by itself be a crime?" she wrote.
AISA president Neha Bora also demanded that all of the protesters who have been detained or arrested, including Dipke, be released immediately. "During this movement, they (police) have been detaining people illegally in the evening and releasing them the next morning or evening. We do not understand which law allows these kinds of detentions. The protesters who have been detained should be released, including Abhijeet Dipke. The sort of curfew that has been imposed in central Delhi should also end," they said.
CJP spokespersons Ahutosh Ranka and Saurav Das, meanwhile, were ordered to spend five days in jail after they scaled police barricades at Jantar Mantar. They were also asked to sign bonds that required them to maintain peace and good behaviour for one year after being detained during an earlier protest.
According to police, around 150 people had been detained to maintain law and order and ensure smooth traffic movement.
