CBI probe into Thanjavur student suicide can proceed: SC

TN argues single-justice bench of HC had overstepped its jurisdiction

The Supreme Court on Monday declared it would not interfere with the CBI probe into the suicide of a teenage student in Thanjavur district of Tamil Nadu.

The DGP of Tamil Nadu had filed a special leave petition in the Supreme Court against the order of the Madurai bench of the Madras High Court that transferred the probe of the Thanjavur case to the CBI.

The bench of Justices Sanjiv Khanna and Bela M. Trivedi on Monday issued notices to all parties in the case, returnable in four weeks.

The top court said that there are two aspects of the matter: One is there are certain observations recorded in the impugned judgment and the second is regarding the final order directing probe by CBI. The apex court said it might not be appropriate for it to interject in the investigation of the CBI but it will issue notice on the first aspect.

The Christian order that ran the missionary school where the student studied had also issued a SLP challenging the High Court order. The Supreme Court also issued notice in connection with this SLP.

Advocate Mukul Rohatgi appeared for the DGP. Advocate P. Wilson, who appeared for the state of Tamil Nadu, argued the single-justice bench of the Madras HC had overstepped its jurisdiction by ordering a CBI probe as it had authority only to deal with matters of the state police. He argued the prayer in the petition was for a CB-CID probe, with need for CBI probe only voiced orally, Live Law reported.
