A case has been filed in Jaunpur district of Uttar Pradesh against former Jammu and Kashmir chief minister Mehbooba Mufti over her allegedly provocative remarks against the national flag last week.

Mehbooba Mufti had stated on October 23 that members of her People's Democratic Party would not hoist the national flag unless they are allowed to raise the flag of Jammu and Kashmir.

Article 370 of the Constitution, which was abrogated last year, had provided for Jammu and Kashmir having a separate flag.

The Hindustan Times reported on Friday that "Himanshu Srivastava, who filed the case through advocate Upendra Vikram Singh on Wednesday, said Mufti’s comments on October 23 tantamount to treason."

"Srivastava said Mufti is yet to apologise for her statement and that she has allegedly tried to weaken the country and incited enmity, disharmony and hatred," Hindustan Times reported.

Srivastava claimed the court would take up the case against Mufti for hearing on November 27.

Earlier this week, three leaders of the PDPformer MP T.S. Bajwa, former MLC Ved Mahajan and former state secretary Choudary Hussain Ali Wafa—resigned from the PDP to protest against Mufti's remarks against the national flag.

The Jammu and Kashmir BJP unit had demanded Lieutenant Governor Manoj Sinha book Mufti for sedition for her utterances against the national flag.

BJP state unit president Ravinder Raina said, “I warn leaders like Mehbooba Mufti not to instigate the people of Kashmir. We will not allow anyone to disturb peace, normalcy and brotherhood. In case anything wrong happens, she will have to face the consequences."

Raina added that those Kashmiri leaders who felt insecure in India could go to Pakistan or China.

On October 26, four BJP workers were detained for attempting to hoist the national flag at the Lal Chowk in Srinagar during a protest against Mufti.
