Mumbai, Jul 8 (PTI) Six years after a man was killed as he intervened in a fight between two neighbours, a sessions court here on Tuesday sentenced two men to life imprisonment.
Additional sessions judge A Subramaniam held Siddhesh Dagale and Suraj Salve guilty of murder and other relevant offences under the Indian Penal Code.
Besides handing down life imprisonment, the court also imposed a fine of Rs 80,000 on each of them.
Two other accused, Umer Ibrahim Sayyad and Jitendra Tawre, were acquitted of all charges.
As per the prosecution, a dispute arose between complainant Vinayak Mahadeshwar and Dagale following the demolition of Dagale's house by the Brihanmumbai Municipal Corporation. Dagale suspected that it was Mahadeshwar who had complained to the BMC about his house.
On the night of April 24, 2019, Salve called Mahadeshwar to meet him near Dagale's house. Mahadeshar, accompanied by deceased Dnyanesh Gurav and two other friends, reached the spot.
Dagale confronted Mahadeshwar, asking if he had complained to the BMC.
It led to a fight, during which Dagale picked up a wooden log to hit Mahadeshwar. Gurav intervened, and took the blow.
He was rushed to hospital where he succumbed.
Prosecutor Ashwini Rayakar examined 12 witnesses during the trial.
Relying on the testimonies of the complainant, eye witnesses and medical evidence, the judge concluded that Gurav's death was a culpable homicide.
"....on consideration of evidence, I find that there is sufficient evidence to hold that Dagale and Salve committed the murder of Gurav," the court ruled.
