Nawada MLA and Aam Janta Unnayan Party Chairman Humayun Kabir has been arrested on charges of violating the law during the Rajinagar by-election on Tuesday.
He was taken away from his party office in Murshidabad on Tuesday after a heated argument with the police.
The detention came after he cast his vote in the Rejinagar Assembly constituency by-election. The by-elections are taking place in five assembly seats across West Bengal, Tamil Nadu, Puducherry and for a Lok Sabha seat in Assam.
In West Bengal, the by-elections are taking place in Nandigram and Rejinagar constituencies.
The voting began at around 7 am. Humayun had gone to the booth with his son Golam Nabi Azad and other family members.
He had raised concerns about the police presence around his house.
"Ask Shuvendu about this." He then added, "Is this a war with Pakistan? Muslim voters of Rejinagar have been harassed for two months. People are entering houses and looting, vandalising them, and trying to rob the dignity of mothers and sisters."
Kabir had alleged that the police interfered with polling at several booths and that 64 people were detained over the past two months.
He also accused the police of targeting people in the constituency in the run-up to the by-poll.
“The accusations have just begun. The police themselves are hijacking the voting process at many booths. In India’s republic and under the Constitution, the police are meant to ensure the safety and security of the people; that is their duty. Yet, they are the ones hijacking the vote. Why is there a need to hijack votes? The govt is already established,” Kabir told ANI.
The AJUP leader also alleged that the police are working for the BJP.
The police reached the AUJP office in Rejinagar and told him that he cannot be present in the office during the polling day.
The situation escalated into a scuffle, and police personnel forcibly led him to the vehicle. He was taken to Rejinagar police Station.
Humayun’s son Golam is running for the Rejinagar seat, while the BJP fielded Sakharav Sarkar. Mamata-led TMC fielded Rabiul Alam Chowdhury; the rival TMC candidate is Safiuzzaman Sheikh; the Congress nominee is Mohammad Abdullahil Kafi; and CPI(M)'s nominee is Syed Asad Ali. The Rejinagar seat became vacant after Kabir, who won from both Rejinagar and Nowda, resigned from one of them.
