Tyler Robinson, 22, who was arrested on Thursday night, is set to be charged with aggravated murder in the tragic killing of conservative activist Charlie Kirk.
Besides aggravated murder, Tyler is likely to be charged with felony discharge of a firearm causing serious bodily injury and obstruction of justice. All of them are state charges and not federal.
Will Tyler Robinson get death penalty?
In the state of Utah, aggravated murder is the only crime for which the death penalty is a sentencing possibility.
This comes as US President Donald Trump called for death penalty for the killer of his ally Charlie Kirk. "I hope he’s going to be found guilty and I hope he gets the death penalty," Trump said.
However, it should be noted that Utah has given capital punishment to only seven people since 1977. Usually, aggravated murder is a non-capital first-degree felony charge. In such cases, typically prosecutors seek a life sentence without parole or a minimum sentence of 25 years, according to New York Post.

FBI chief Kash Patel described the arrest of the suspect as 'historic' for concluding the manhunt within 33 hours.
Tyler, who acted alone according to the officials, shared messages on Discord chatroom detailing the aftermath of the killing. In the chat, he discussed the engravings on the bullets and where he went after the shooting.
He also said in the chat that he has retrieve a bolt-action rifle from a drop point. In the message, Robinson said he wrapped the rifle in a towel and stashed it in a bush. He also revealed that he used a scope to shoot Charlie Kirk and changed his clothes after the shooting.
Later, Tyler confessed the murder to his father, Matt Robinson, who immediately called police and turned his son in on Thursday night.
