Gurugram hit-and-run: ‘Shouldn't happen to any woman’, says Sia's family while seeking strict action; accused's lawyer blames bikers

In the wake of the arrest of accused Kalyan Bainsla in connection with the Gurugram hit-and-run case, family members of the victim, Shivani Chauhan alias Sia, pressed for strict action, saying such an incident should never happen to another woman.

Bainsla has been arrested in connection with the incident involving Sia on Gurugram's Golf Course Road.

Reacting to the arrest, Sia's father welcomed the police action and said the family wanted a thorough investigation. "If he has been arrested, that is a very good thing... The police are doing a good job by conducting a thorough investigation. We want to ensure that no such incident ever happens to any woman in this country. People need to change their mindset," he said.

He maintained that what happened to his daughter was not merely a road accident.

"This wasn't an accident; it was an attempt to murder. This isn't mere rash driving; it was a deliberate attack," he alleged.

Sia's father had earlier said the family was not happy with the sections initially invoked and had sought the inclusion of charges relating to hit-and-run, attempted murder and harassment.

He alleged that the person who hit his daughter showed "absolutely no guilt" and insisted that an attempt-to-murder charge should be invoked.

Sia had also released a video on social media levelling serious allegations against Bainsla. Following this, Gurugram police added the charge of attempt to murder under Section 109 of the BNS.

Bainsla's lawyer Naveen Bainsla, meanwhile, offered a completely different version of the events and claimed that the incident was not a hit-and-run.

"This is not a hit-and-run case; it is a matter of negligence," he said.

The lawyer alleged that a group of around 20-30 bikers had been speeding, performing stunts and provoking other vehicles to race or overtake. He claimed the collision occurred because of the speeds involved and maintained that both sides were at fault.

He also sought to defend Bainsla's character, saying, "Kalyan Bainsla is from my village. He is a very good man; he is a national and international Kabaddi player. There hasn't been a single complaint against his family to date; they are a very socially respected family," the lawyer said.

He also rejected allegations that Bainsla had been drinking, saying the incident occurred around 7 am and that his family members were with him.

"He is a gym trainer and a gym owner," the lawyer added, maintaining that it was "strictly a case of negligence".

Sia was riding her Aprilia RS 457 sports bike with a group of bikers on Golf Course Road on Sunday when a car began following them. She had alleged that the occupants approached her and started misbehaving. When she asked them to maintain their distance, they told her to stop her motorcycle, she claimed. Sia also alleged that the occupants appeared to be intoxicated.

She said that a short while later, while overtaking, the car struck her motorcycle from the side, causing her to fall.

The incident was captured by a camera mounted on her motorcycle. Footage subsequently shared on social media shows the car hitting the bike and sending it skidding for several metres.

DCP East Gurugram Sandeep Kumar said police used a glimpse of the accused visible in the video to launch a search and established that he was from Palwal.

Three police teams worked overnight before Bainsla was arrested from Dausa.

Police said another person was with him at the time of the incident and that his role was being examined.

Dausa Sadar Police Station SHO Yudhishthir Singh said a team from Sohna had informed the local police that the alleged accused Kalyan Bainsla and Lavnish had been detained from the Agra Road area and subsequently taken to Gurugram.
