Tensions flared up in the Supreme Court on Friday when a petitioner, representing himelf, "ordered" a two-judge bench to listen to his instructions.
The man, identified as Prabal Pratap, addressed the two-judge bench of Justices KV Vishwanath and Alok Aradhe as “judicial servant”, and even abused the Chief Justice of India, Surya Kant, according to videos of the incident, which are going viral.
“Mister judicial servant, I order you to order the registration of FIR against ACP Vikas Nagar Lucknow,” the petitioner could be heard saying in a case challenging an Allahabad High Court order, which had dismissed his writ petition.
He had then approached the Supreme Court against his application being converted into a private complaint case under Section 173(4) of the Bharatiya Nagarik Suraksha Sanhita (BNSS).
“You are ordering me? You are ordering us?” asked a surprised Justice Vishwanath. "I am sovereign," Pratap replied, further confusing the judges.
He then shocked the entire courtroom by flinging the case papers in the air and abusing CJI Surya Kant.
"Yeh de dena **** CJI ko (Give these to the **** CJI)," he said, abusing the CJI as he was quickly restrained by security personnel inside the apex court.
Despite the courtroom drama, the bench took no action against him, and even passed a ruling, based on the merits of the case.
"As far as the merit of this case is concerned, we have perused the records, we find no good ground to interfere with the impugned judgment/order(s)," the bench said, as per a LiveLaw report.
Notably, this comes almost a year after a lawyer named Rakesh Sharma went viral for throwing a shoe at the then CJI B.R. Gavai.
Kishore's protest allegedly stemmed from CJI Gavai’s remark—a month before the incident—amid a hearing on a plea seeking reconstruction of a damaged Lord Vishnu idol at Khajuraho’s Javari Temple.
