Saurabh Luthra and Gaurav Luthra, the two owners of the Goa nightclub where a devastating fire claimed 25 lives on Saturday, have filed an anticipatory bail application in a Delhi court.
The Sessions Court in Rohini is likely to hear the matter on Wednesday, a lawyer from their legal team has confirmed.
The duo flew to Phuket in Thailand hours after the fire incident at their 'Birch by Romeo Lane' nightclub, and an Interpol Blue Corner Notice has been issued against them.
Their immigration records show they departed on an IndiGo flight 6E 1073 at 5.30 am on Sunday. They were also spotted at Phuket airport, if photos circulating on social media are to be believed.
Both Saurabh and Gaurav have been charged with BNS Section 105 for culpable homicide, not amounting to murder, Section 125(a)(b) for endangering lives and personal safety and Section 287 for negligent handling of fire.
Meanwhile, Ajay Gupta, one of the co-owners of the club, was detained on Tuesday evening and brought to Delhi's Anti-Extortion and Kidnapping Cell of the Crime Branch this morning.
According to reports, the Goa Police have questioned him and initiated formal procedures to apprehend him and seek a transit remand. He will face detailed questioning in Goa about the club's management, operational responsibilities and fire-safety compliance.
The police have already arrested five persons—the nightclub's chief general manager Rajiv Modak, general manager Vivek Singh, bar manager Rajiv Singhania, gate manager Riyanshu Thakur and employee Bharat Kohli.
At least 25 people, including four tourists, were killed in the devastating fire that struck the nightclub in North Goa on Saturday night. The popular party venue at Arpora village, around 25 km from the state capital Panaji, opened last year.
