Setback for Subramanian Swamy in Sunanda case

The Delhi High Court on Thursday dismissed Subramanian Swamy's plea seeking probe into death of Congress leader and MP Shashi Tharoor's wife Sunanda Pushkar. Criticising Swamy's PIL, the high court said it is left with distinct impression that this is perhaps a textbook example of "political interest litigation" being dressed up as PIL.

"Swamy appears to have concealed data or information which he should have disclosed at the first instance," the HC noted as it dismissed the PIL. The court, which had resumed hearing in the case on Thursday, was told by the Centre and Delhi Police that they do not subscribe to the view expressed by Swamy that probe in the case has been influenced by Shashi Tharoor. 

The bench also said that from what was placed before the court, it was unable to be persuaded that the probe, being carried out by the SIT, is botched up or under the influence of any party.

The HC reminded that courts across the country need to be careful that judicial process is not used by political persons for their own purposes.

Swamy had filed the PIL in the high court in July seeking a court-monitored enquiry into the mysterious death of Pushkar. He has now demanded to make the Enforcement Directorate (ED) a party in the case and the matter has also to be investigated under the PMLA.
