SC to pronounce triple talaq verdict on Tuesday

The Supreme Court, on Tuesday, will deliver its judgment on the constitutionality of the practice of triple talaq.

A five-judge bench headed by Chief Justice of India J.S. Khehar will deliver its verdict in the matter after having heard impassioned arguments from petitioners urging the court to term the practice as unconstitutional and ban it as also those who argued the issue lay in the ambit of the personal laws of the Muslim community and hence any change has to come from within.

The case is listed for judgment at 10.30am in the chief justice's court. The apex court has, since May 11, heard appeals against the practice of triple talaq, hearing the matter of Constitutional significance even during the summer vacation.

Leading the charge were Muslim women who were themselves at the receiving end of instant divorce. The Union government has taken the stance that practices such as triple talaq, nikah halala and polygamy went against the Muslim woman's right to life and hence had to tested against the touchstone of whether they were in violation of the Constitution.

The All India Muslim Personal Law Board in its representation, before the court, appealed against any legal intervention in the issue, saying any reform had to be initiated from within the community.

The bench that has heard the matter and will give its verdict is a multi-faith one, comprising a Sikh (Khehar), Christian (Kurian Joseph), Muslim (S. Abdul Nazeer), Hindu (U.U. Lalit) and Parsi (R.F. Nariman).

This will one of Khehar's final judgments. August 25 is his last working day as CJI. He is also expected to deliver the verdict on the issue of whether privacy constitutes a fundamental right before he retires.
